1. Acceptance of Terms

By downloading, installing or using the UndeadChords application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not accept these terms, do not use the App.

Using the App constitutes full acceptance of these Terms.

2. Description of Service

Nature of the App

UndeadChords is a digital notebook application designed for musicians. It allows you to:

• Create and store personal songs (lyrics and chords entered by the user)
• Search for estimated harmonies to practice accompaniment in an artist's style
• View chord diagrams
• Use a tuner

Personal Content and Style Search

The App offers two types of content:

• Personal songs: Users create, enter and manage their own songs (lyrics and chords). Users are solely responsible for the content they enter.
• Style search: The App provides estimated harmonies (chord progressions) for practicing accompaniment in an artist's style. This content does not contain lyrics — text is replaced by placeholder characters (░). These chord grids are educational estimates and do not constitute reproduction of copyrighted works.

The App does not provide, host or distribute any copyrighted song lyrics.

3. User Responsibility

Content Responsibility

The user is solely and exclusively responsible for:

• Content they create or enter in the App (notably lyrics they write or transcribe themselves)
• The legality of content stored on their device
• Compliance with copyright, neighboring rights and intellectual property rights
• Obtaining necessary permissions for any protected content they enter
• How they use the personal songs they create in the App

Device Responsibility

The user is solely and exclusively responsible for:

• Their phone, tablet or any device on which the App is installed
• The security of their device (passcode, encryption, antivirus)
• Backing up their data
• Third-party access to their device
• All content stored on their device, whether or not related to the App

The App cannot be held responsible for any security breach, theft, loss or unauthorized access to the user's device.

User Commitments

By using the App, the user agrees to:

• Not use the App for illegal purposes
• Not store illegal, defamatory content or content infringing third-party rights
• Comply with copyright laws in their country
• Use the App only for personal and educational purposes
• Not attempt to bypass security measures or limitations of the App

4. Intellectual Property

Rights to the App

The UndeadChords App, its source code, design, icons and interface are the exclusive property of its developers. Any unauthorized reproduction, modification or distribution is prohibited.

Rights to User Content

The user retains all rights to content they create themselves. The App claims no rights to user content.

Estimated Harmonies

The chord grids provided by the style search feature are algorithmic estimates for educational purposes. They contain no lyrics and do not constitute reproduction of copyrighted works. Chord progressions are not copyrightable.

5. Limitation of Liability

Disclaimer of Warranties

The App is provided "AS IS", without warranty of any kind, express or implied, including but not limited to:

• No warranty of merchantability
• No warranty of fitness for a particular purpose
• No warranty of error-free or bug-free operation
• No warranty of uninterrupted operation

Limitation of Damages

In no event shall the App developers be liable for:

• Any direct, indirect, incidental, special or consequential damages
• Any loss of data, profits or business
• Any third-party claims
• Any damage resulting from the use or inability to use the App

Liability Cap

The total liability of the developers, whatever the cause, is limited to the amount actually paid by the user for the App in the last 12 months.

6. Copyright and DMCA

App's Position

The App does not distribute copyrighted lyrics. The style search feature only provides estimated chord progressions (not copyrightable) with placeholder characters instead of lyrics. Text content (lyrics) entered by users is stored locally on their device and is their sole responsibility.

Notification Procedure

If you are a rights holder and believe your rights are affected:

1. User-entered content (personal lyrics) is stored locally on user devices — we cannot access or delete it
2. For any questions regarding estimated harmonies, please contact us at contact@undeadchords.com
3. We will take appropriate action in accordance with applicable law

7. Limitation of Claims and User Responsibility

No claims against the developers: The App provides only estimated chord progressions (not copyrightable) and does not distribute any copyrighted content. No claim for damages or indemnification can be made against the developers regarding the content provided by the App.

User responsibility: Users are solely responsible for any personal content (lyrics) they enter in the App. Any legal consequence arising from copyrighted content entered by a user is the exclusive responsibility of that user.

8. In-App Purchases

Premium Version

The App offers a paid Premium version unlocking additional features. This purchase is:

• Managed by Apple through the App Store
• Non-refundable (except per Apple's policy)
• Permanent (one-time purchase, not a subscription)

Refund Policy

Refund requests must be addressed directly to Apple in accordance with their policy.

9. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will take effect upon posting in the App or on our website.

Continued use of the App after modification of the Terms constitutes acceptance of the new conditions.

10. Termination

By User

The user may stop using the App at any time by uninstalling it from their device.

By Developers

We reserve the right to suspend or terminate access to the App in case of violation of these Terms.

11. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in effect.

12. Governing Law and Jurisdiction

These Terms are governed by French law.

Any dispute relating to the interpretation or performance of these Terms shall be subject to the exclusive jurisdiction of French courts.
